GENERAL TERMS AND CONDITIONS (GTC) for the MagicPrints Platform
General Provisions
Orders placed through the MagicPrints platform are subject solely to these General Terms and Conditions (GTC). Any differing provisions from the buyer are only applicable with our explicit consent. We reserve the right to make necessary changes due to technological developments, as well as technical differences in form, color, and weight. The MagicPrints platform is operated by Alpha Brands & Assets AG.
Offer and Conclusion of Contract
The operator of the website, Alpha Brands & Assets AG, reserves the right to refuse orders without justification. MagicPrints is not obligated to fulfill orders itself and may carry out the orders through subcontractors. The operator also reserves the right to have certain manufacturing steps performed by external service providers.
Copyrights and Usage Rights
Copyright: Printing the patterns received by MagicPrints is done at the customer's risk, who assumes that they have the necessary rights for reproduction.
Usage Rights: MagicPrints does not require exclusive usage rights to the designers' works. When a design is sold, the buyer does not acquire usage rights. The designer retains all rights. MagicPrints only provides the platform, infrastructure, and services, including printing and shipping.
Data Processing
Customer and designer data may be stored and processed electronically if necessary for transaction completion and in compliance with applicable data protection laws. We do not assume responsibility for the data. Customers and designers agree that their data may be used by MagicPrints for advertising purposes.
Complaints and Warranty
Complaints must be reported within five working days of receiving the goods. An "approved plan" or current sample exempts Alpha Brands & Assets AG from liability.
Delivery Deadlines and Transfer of Risk
MagicPrints will do its best to meet delivery deadlines, but these are only binding if explicitly confirmed. In the case of force majeure, strikes, or other unforeseen circumstances, Alpha Brands & Assets AG is not liable. The risk of accidental loss or damage to the goods is transferred to the buyer upon delivery.
Shipping, Payment Terms, and VAT
Shipping is carried out according to the chosen method at the time of order. Prices are stated as purchase prices excluding VAT and additional costs. Payment is due immediately, according to the selected payment method. Shipping costs are charged separately unless otherwise agreed.
Retention of Title
The goods remain the property of the seller until full payment of the purchase price, regardless of whether the goods are delivered directly by the seller or by a third party.
Offer
The offer available on the MagicPrints platform may be modified without prior notice. The seller retains ownership and copyright of the designs, plans, sketches, and other materials.
Compensation and Payment for Designers
Compensation Structure: Designers are compensated based on the subscription they choose.
Commission: Designers only receive a commission after the sale of print sheets.
Contract Terms and Consent
By registering, designers accept the GTC, the code of conduct, and the seller guidelines.
Marketing and Sales
MagicPrints actively promotes designs on social media platforms and through influencers.
Support and Customer Service
MagicPrints provides German and English language support via the website's chat feature, WhatsApp, Facebook, and Instagram.
Final Provisions
The invalidity of any provision of these GTC does not affect the validity of the remaining provisions.
Place of Performance and Jurisdiction
The place of performance and exclusive jurisdiction for any disputes is Switzerland.
